The Stay Edit - Content Creation Terms

1. Parties

These Content Creation Terms apply between:

The Stay Edit

and

Any client engaging The Stay Edit for content creation, photography, videography, social media content, presenter-led content, marketing campaigns, or related creative services (“Client”).

2. Services

The Stay Edit will provide the services outlined in the applicable proposal, invoice, package, booking confirmation, email correspondence, or written agreement (“Services”).

Services may include, but are not limited to:

Photography
Videography
Social media content
Reels and short-form video
Presenter-led content
Drone footage
Content strategy
Marketing campaigns
Creative direction
Content editing and production

Deliverables will vary depending on the agreed package and scope of work.

3. Creative Direction

The Client acknowledges that all content will be created in accordance with The Stay Edit’s creative style, editorial standards, and professional judgement.

While reasonable preferences may be considered, final creative decisions remain at the discretion of The Stay Edit.

The Stay Edit does not guarantee that all requested shots, angles, concepts, weather conditions, or creative ideas will be captured.

4. Third-Party Contractors

The Stay Edit may engage photographers, videographers, drone operators, presenters, editors, content creators, or other contractors to assist in delivering the Services.

The Client acknowledges that content may be captured by The Stay Edit or approved third-party contractors acting on behalf of The Stay Edit.

The Stay Edit remains responsible for managing the project and delivering the agreed Services.

5. Client Responsibilities

The Client agrees to provide:

Safe and reasonable access to the property
Access to all agreed shoot locations
Access to any amenities, experiences, facilities, food, beverages, styling elements, or inclusions intended to be featured
Accurate information regarding the property and guest experience

The Stay Edit is not responsible for missed content opportunities resulting from unavailable access, unavailable amenities, guest interruptions, weather conditions, or circumstances outside its reasonable control.

6. Hosted Stay Requirements

Where accommodation is required to facilitate the Services, the Client agrees to provide the hosted stay arrangements outlined within the agreed package, proposal, or booking confirmation.

Hosted accommodation forms part of the agreed project requirements and is separate from the fees payable for the Services.

7. Travel

Travel fees may apply for locations outside The Stay Edit’s standard service area.

Any applicable travel costs will be disclosed and agreed prior to booking.

Remote locations, ferry transport, flights, accommodation requirements, or extended travel may incur additional fees.

8. Delivery Timeframes

Unless otherwise agreed in writing, final edited content will generally be delivered within 7–10 business days following the shoot.

Delivery timeframes may vary depending on project complexity, seasonal demand, contractor availability, or unforeseen circumstances.

9. RAW Files and Unedited Content

The Stay Edit does not provide RAW files, unedited footage, unedited images, project files, working files, or unused content captured during the course of the Services.

Clients will receive only the final edited deliverables included within their agreed package unless otherwise agreed in writing.

10. Revisions

The Stay Edit does not provide revisions unless an error has been made in delivering the agreed scope of work.

Any additional edits, revisions, re-shoots, or creative changes requested by the Client may be quoted separately at The Stay Edit’s discretion.

11. Usage Rights

Upon full payment, the Client is granted a perpetual, worldwide, non-exclusive licence to use the delivered content for:

Social media
Websites
Email marketing
Digital advertising
Print marketing
Public relations activities
Promotional purposes

The Client may not:

Resell the content
Sublicence the content to third parties
Claim authorship of the content

The Stay Edit retains the right to use the content for portfolio purposes, social media, website content, directory listings, marketing materials, advertising, editorial features, awards submissions, media opportunities, and other promotional activities.

12. Drone Operations

Drone footage is subject to:

Weather conditions
Airspace restrictions
CASA regulations
Safety requirements

The Stay Edit does not guarantee drone content will be available for every project.

13. Cancellations and Rescheduling

If the Client cancels within 7 days of a confirmed booking, The Stay Edit reserves the right to retain any deposit paid and recover any reasonable costs already incurred.

Where possible, both parties will work together in good faith to reschedule.

The Stay Edit reserves the right to postpone or reschedule services due to:

Severe weather
Illness
Safety concerns
Contractor unavailability
Circumstances beyond its reasonable control

14. Fees and Payment

Payment terms will be outlined in the applicable proposal, invoice, package agreement, or booking confirmation.

Unless otherwise agreed:

Deposits are non-refundable
Final payment is due prior to delivery of final content
Late payments may delay content delivery

15. Content Performance

The Stay Edit provides content creation and marketing services only.

The Stay Edit does not guarantee bookings, enquiries, sales, website traffic, social media growth, engagement, reach, advertising performance, revenue, or any specific commercial outcome arising from the use of the content.

Content performance may be influenced by factors outside The Stay Edit’s control, including market conditions, pricing, availability, algorithms, advertising spend, seasonality, and audience behaviour.

16. Refunds

Refunds will only be provided where required under Australian Consumer Law.

17. Limitation of Liability

To the maximum extent permitted by law, The Stay Edit’s liability is limited to:

Re-supplying the Services; or
Refunding the amount paid for the Services.

The Stay Edit is not liable for indirect, incidental, consequential, or business losses arising from the use of the delivered content.

18. Relationship to Listing Terms

Relationship to Listing Terms

These Content Creation Terms apply in addition to The Stay Edit Listing Terms & Conditions.

Where a Client purchases both a listing and content creation services, both sets of terms apply.

In the event of any inconsistency relating to content creation services, these Content Creation Terms prevail.

19. Governing Law

These Terms are governed by the laws of South Australia.

20. Acceptance

By engaging The Stay Edit for content creation services, accepting a proposal, approving a quote, paying an invoice, signing an agreement, or otherwise instructing The Stay Edit to proceed with the Services, the Client agrees to these Content Creation Terms.
